My approach emphasizes comprehensive initial estate analysis, strategic timing of distributions, and meticulous attention to filing deadlines with the Register of Wills.

The modern trust instrument represents one of the most sophisticated developments in American property law. Through careful drafting and implementation, trusts serve as vehicles for wealth preservation, tax efficiency, and intergenerational transfer of assets. The flexibility of trust structures – from simple living trusts to complex dynasty arrangements – allows for precise calibration to specific family circumstances and objectives. Maryland trust law, building upon centuries of common law precedent while incorporating modern statutory frameworks, provides robust mechanisms for asset protection and distribution control. In my practice, I emphasize the technical precision required for trust formation and administration, particularly regarding issues of trustee powers, beneficiary rights, and fiduciary obligations.
Wills
Testament drafting represents a critical intersection of property disposition and documentary formalities. Maryland law maintains strict requirements for testamentary instruments, from witness attestation to capacity determinations. Effective will drafting requires careful consideration of asset composition, family structure, and potential contingencies. The instrument must address not only primary dispositive provisions but also, fiduciary appointments, and powers of administration. Particular attention must be paid to potential issues of pretermitted heirs, elective share rights, and ademption. In my practice, I emphasize comprehensive preliminary analysis of the testator’s asset structure and family circumstances to ensure the resulting instrument achieves both technical compliance and practical efficacy.
Probate
The Maryland probate process operates within a carefully structured judicial framework, combining elements of court supervision with statutory procedures for estate administration. The jurisdiction of the Orphans’ Court, while limited, encompasses critical aspects of estate settlement, from the admission of wills to probate through final administration accounts. Understanding the technical requirements for inventory preparation and account filing, The process demands careful attention to creditor notice requirements, and statutory priorities for distribution. Of particular importance is the interaction between probate administration and other professionals, such as real estate agents, appraisers (both real and personal property), accountants and contractors. My approach focuses on assisting the fiduciary to work with the right professionals for the various areas of administration that fall outside of where a lawyer can assist to ensure a seamlessness when documenting the work of these necessary professionals for estate filings.

Phil Karasik
Principal
Mr. Karasik has been practicing law in Maryland for over two decades. His practice is focused on trusts, estates, and guardianships, where Mr. Karasik has served in over 200 cases as a court-appointed personal representative guardian and Trustee. As a court-appointed fiduciary, he has been tasked to marshal, manage and/or administer tens of millions of assets as well as securing Long-Term Medical Assistance (Medicaid) for beneficiaries in need as a fiduciary and arm of the Court over the years. Mr. Karasik has also sold numerous real estate holdings for beneficiaries in his various fiduciary roles for the Court.
In addition to his role as frequently appointed court fiduciary, Mr. Karasik has served as the attorney for a considerable number of estates and guardianships, offering clients guidance in estates both large and small; treating all matters with an equal level of attention and effort whether the value of the estate is nominal or in the millions.
Mr. Karasik is a native of Montgomery County, who clerked for the Honorable Durke G. Thompson, in Montgomery County Circuit Court prior to entering private practice. Mr. Karasik earned his bachelor’s in Business Administration from Mary Washington College, a Masters from the University of Maryland, College Park, and his JD from the University of Baltimore School of Law, where he graduated cum laude and was a member of the school’s Law Review.
Mr. Karasik spends his spare time raising and coaching his two children and playing tennis and basketball. He’s been involved with the community all his life and has given back in the past to teach as an Adjunct Professor at Montgomery College and speak in Guardianship training classes.
